This is a great way to encourage your online community to register to vote. Bands can also become partners with Rock the Vote which is a slightly longer more complicated process, but the benefit is that the voter reg tool has your logo on it, the person registering can opt-in to receiving information from you, and RTV will give you the name & email of everyone who registers from your site. (This could allow you to send a personal email thanking them for registering, and in the days before the election reminding people to vote.) State primaries and caucuses are the way that the political parties determine their respective party’s candidate for President. They are important not only because they determine the candidates, but also because the issues and platforms of candidates that do well but do not win are often adopted by the winning candidate. 

The 2008 election will see the earliest and most condensed primary season in history. The effects could completely change the political landscape influencing candidates nominating strategies in every way, from where they compete, when they start television campaigns, to how they spend their money.

__''Are there guidelines for musicians who want to perform for or support a candidate?''__

In January 2008, ATC asked election lawyer Caroline Goodson  to give us some guidelines. This is what she came up with:

# Concerts/Other Performances for Presidential Campaign and National Party Committee (DNC) or (RNC)
**Artists can donate their time and services, rights to performance, use of name and likeness, without limit.
**Artists cannot force other people (crew, production labor, etc) to donate their time.
**Businesses cannot donate use of their facilities or equipment—lighting, audio, studio time, production services, etc. The campaign or party committee must pay fair market value.
**Artists can pay vendors for use of their facilities or equipment, but only up to individual contribution limits--$2,300 per person to presidential campaign (until the Convention); $28,500 per calendar year to each national party committee (subject to aggregate limits—see below).
**Composing society payments—same.
# Concerts/Other Performances for Nonprofit Organizations and 527 Groups  
**Artists can donate their time and services, rights to performance, use of name and likeness, without limit.
**Businesses can donate use of their facilities and equipment—lighting, audio, studio time, production services, etc. except for broadcast ads within 30 days of a primary/National Convention or 60 days of the general election.
#Aggregate Limits on Contributions by Individuals ($108,200 total per 2-year cycle)
**Up to $42,700 per 2-year cycle (2007-08) to all federal candidates put together. Contributions to candidates for U.S. Senate count in this cycle regardless of the year of the election.
**Up to $65,500 per 2-year cycle (2007-08) to all national party committees (DNC, DSCC, DCCC, RNC, NRSC, NRCC); federal accounts of state parties; and federal PACs (Emily’s List, HRC, GOPAC, COLE PAC) combined, of which no more than $42,700 may be given to entities other than national party committees.
**Contributions to nonprofit organizations and 527 groups—no limit.
# Merchandise
+Merchandise with political messaging: (i) If sold by a company, for profit, can say anything; money goes to the company; company could give proceeds to a 527 or c-4, but not to a campaign or party committee; (ii) a candidate or party committee could be licensed to use artist's name, likeness or merchandise (but may have to pay if rights are held by a firm rather than by artist individually); then all proceeds go to the candidate or party committee.
# Concerts/Non-Affiliated Shows
+From stage: At one of their regular shows, they can say anything; a show sponsored by/for benefit of a c-3, should not say anything partisan; a show sponsored by/for the benefit of a campaign or party committee, can say anything; a show sponsored by/for a 527, technically cannot expressly advocate election or defeat of any federal candidate.
# Interviews/Press Releases
+Interviews, never a problem—artists can say anything. Press releases--issued by band as a group of individuals, not by a corporate entity, can say anything.
# Endorsing
+A band or band member endorsing a candidate (for example, in an interview), does not affect anything else they can do.

__''Are there legal considerations for endorsing candidates on ))MySpace(( pages or other social networking sites?''__

ATC's legal contact at Perkins Coie's Political Law Group advises that:
Even though a ))MySpace(( page is not owned by the band, if the band is a corporate entity then it will want to avoid the appearance of using corporate funds for communications to those outside the restricted class that expressly advocate the election or defeat of a candidate.  If incorporated bands want to take that risk, we advise them to retain counsel.

__''What do the different classifications of organizations mean?''__

__501 (c)(3):__  A 501 (c)(3) is the most common nonprofit. Donations are tax-deductible and all finances must be reported to the IRS. These nonprofits must be humanitarian, educational or scientific in nature. They are not allowed to engage in politics, except in what is called “Get-Out-The-Vote” (GOTV) capacities. These include voter education & registration. They are limited in their ability to lobby or talk about legislation and are not allowed to endorse or engage with campaigns for public office. Any of these activities could be grounds for revocation of the organization’s tax status by the IRS (this happened to the Sierra Club several decades ago).  A 501(c)(3) may establish a 501(c)(4).  EXAMPLES INCLUDE Rock the Vote, Greenpeace, Amnesty International, Declare Yourself.

__501(c)(4)__ organizations have fewer tax law restrictions than 501(c)(3) organizations with regard to political activity.  Provided election activity is not the primary function of the 501(c)(4), they can participate in more partisan election-related activity, such as unlimited lobbying (including work on ballot measures), endorse federal candidates for office to the organization’s membership, and in some states, make cash or in kind contributions to state or local candidates.  501(c)(4)s may not coordinate or contribute to any federal candidate or party, make communications to the general public that includes express advocacy for a federal candidate, or engage in electoral activity as the organization’s primary activity.  A 501(c)(4) may establish a 501(c)(3) or a 527. EXAMPLES INCLUDE League of Pissed Off Voters, Grassfire.

__527 Group:__ A tax-exempt organization utilizing a loophole in soft money regulations (which control fundraising for political parties).  These groups are sometimes referred to as Soft Money PACs.  527s can engage in some political activities including voter mobilization efforts, issue advocacy, and can endorse candidates.  527s cannot campaign directly for candidates or engage in lobbying activity (without incurring a tax on the amount spent on lobbying). 527s can raise and spend unlimited amounts of money on issue advocacy and voter mobilization. The line between issue advocacy and candidate advocacy is the source of heated debate. EXAMPLES INCLUDE Moveon.org, Music for America, Swift Boat Veterans for Truth.

__PAC:__ A political action committee, or PAC (sometimes referred to as Hard Money PAC), is a private group organized to elect or defeat government officials.  This is done with the ultimate goal of passing better legislation in support of the group's special interests. PACs are not limited to advertising spent in support of their own issues, but are limited on what they spend on specific candidates, political parties, and other PACs.  PACs can spend:

**no more than $5,000 per candidate per election (primaries, general elections  and special elections are counted separately.)
**no more than $15,000 per political party.
**no more than $5,000 per PAC. PACs are allowed to give to other PACs.

EXAMPLE: In the 2002 elections, the top 5 highest spending PACs  (including themselves, their affiliates and subsidiaries) were: Emily's List ($22,767,521), Service Employees International Union ($12,899,352), American Federation of Teachers ($12,789,296), American Medical Association ($11,901,542), and National Rifle Association ($11,173,358).

!Voter Protection 

Millions of Americans have historically and contemporarily been prevented from exercising their right to vote through a multitude of tactics, some intentional and some not, including voter intimidation, voter suppression, and/or mistakes made by election officials.  Voter Protection efforts seek to ensure that every eligible voter is able to cast their ballots without interference, and have confidence that their votes will be counted fairly in the upcoming elections.

Voter Protection spans a range of issues including: 
*ensuring voters know their rights, 
*bringing communities together to educate and mobilize citizens about fair elections, 
*ensuring all voters have a secure and equal opportunity to cast meaningful ballots including young voters, geographically mobile voters and lower-income voters, 
*litigating where voting rights are violated,
*fighting voter identification requirements when deemed unreasonable,
*outlawing deceptive practices and voter intimidation, 
*restoring voting rights for former prisoners.

Here are some of the ways that musicians can help:

Election Day Registration

Election Day Registration (EDR) sometimes called "same day registration”, allows eligible voters to register and cast a ballot on Election Day. Seven states currently have EDR, a reform that demonstrably increases voter turnout and reduces problems at polling places. Maine, Minnesota and Wisconsin adopted EDR in the 1970s. Idaho, New Hampshire and Wyoming enacted Election Day Registration two decades later and Montana implemented EDR in 2006.

EDR significantly increases the opportunity for all citizens to cast a vote and participate in American democracy: in the 2004 presidential election, EDR states boasted an average turnout 12% higher than that of non-EDR states.

__EDR assists young voters.__
*Young Americans move frequently - for school or for jobs, for example - which makes it harder for them to register to vote.
*EDR could counter the reduced registration rates that their mobility causes by allowing them to register at the last moment and vote.
*In fact, EDR could increase youth turnout in presidential elections by as much as 14%.

__EDR enfranchises geographically mobile and lower-income citizens.__
*Over one of the 40 million Americans who moved between 2004 and 2005 had incomes of less than $25,000.
*Many of these individuals miss the registration deadline in their new election districts, and thus cannot vote.
*EDR would allow these people to re-register on Election Day and cast a ballot.

__EDR counteracts arbitrary voter registration deadlines.__
*27 states cut off voter registration 25 or more days before the election.
*The experience of EDR states shows that these deadlines have little effect on a state's ability to run smooth elections.
